Terms of Service

These Terms of Service ("Terms") are an agreement between you and Nicolas Pla ("we", "us", "our") governing your use of the Crypt Prices mobile application ("the App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The App

Crypt Prices is an unofficial companion app for the game Dark and Darker. It displays market prices and game data sourced from DarkerDB and provides tools to track items, set price alerts, and create character builds. The App requires an internet connection for live data.

2. Not affiliated with Ironmace or DarkerDB

Crypt Prices is a fan-made app. It is not affiliated with, endorsed by, sponsored by, or associated with Ironmace (the developer and publisher of Dark and Darker) or with DarkerDB. All game content, including item names, descriptions, and imagery, is the property of Ironmace. Market and game data is provided by DarkerDB and is subject to DarkerDB's own Terms of Service at https://darkerdb.com/terms-of-service.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own personal, non-commercial use, subject to these Terms and the rules of the app store from which you downloaded the App.

4. Acceptable use

You agree not to:

Use the App for any unlawful purpose
Attempt to reverse engineer, decompile, or interfere with the App or its servers
Use automated means to access the App in a way that burdens our servers or those of DarkerDB
Resell, redistribute, or attempt to extract the App's underlying data feeds for redistribution

5. Supporter subscription

The App is free to use. We also offer an optional "Supporter" subscription that unlocks convenience features such as additional builds and favorites, build sharing, and a supporter badge. Core features, including market prices and price alerts, remain free.

Billing: The Supporter subscription is an auto-renewing monthly subscription billed through your Apple App Store or Google Play account.
Renewal: It renews automatically each month until you cancel. Your account is charged for renewal within 24 hours before the end of the current period.
Managing and cancelling: You can manage or cancel the subscription in your App Store or Google Play account settings. Cancelling stops future renewals; the current period stays active until it ends.
Refunds: Payments are processed by Apple or Google and are subject to their refund policies. Except where required by law or by the applicable app store, fees are non-refundable.
Changes: We may change subscription pricing or features. Changes apply to future billing periods, and we will provide notice as required by the app stores.
Availability: Supporter features depend on the availability of the underlying data service (DarkerDB). If that service becomes unavailable, some features may be limited or discontinued.

6. Data accuracy

Market prices and game data are provided "as is" and are sourced from DarkerDB. We do not guarantee that any price, statistic, or other data is accurate, complete, current, or error-free. Data may be delayed or incorrect. Do not rely on the App as your sole basis for in-game decisions.

7. Intellectual property

The App, including its design, code, and original content, is owned by us and protected by applicable law. Game content is owned by Ironmace, and game and market data is owned by DarkerDB. These Terms do not grant you rights to any third-party content except as needed to use the App.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DATA WILL BE ACCURATE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD 10.

10. Termination

We may suspend or terminate your access to the App or its server features at any time, including if you violate these Terms or if the underlying data service is discontinued. You may stop using the App at any time and cancel any subscription as described above.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the App after changes take effect means you accept the updated Terms.

12. App stores

These Terms are between you and us, not with Apple or Google. The app stores are not responsible for the App or for providing support for it. If you obtained the App from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Governing law

These Terms are governed by the laws of Argentina, without regard to its conflict-of-law rules.
